Defendants File Brief in Appeal of Elam Verdict

MT. VERNON, Ill. -- False testimony and inadmissible expert testimony are among the many reasons the 5th Circuit Appellate Court should reverse the landmark Elam welding rod verdict, defendants in the lawsuit have claimed in their opening brief. Elam v. Lincoln Electric, et al., No. 5-04-0120 (Ill. App. Ct., 5th Dist.).
Filed Aug. 16 in the Illinois 5th Circuit Appellate Court, defendants Lincoln Electric, Hobart Brothers and Airco/The BOC Group additionally contend that the trial court wrongfully excluded testimony that indicated no relationship exists between a central nervous system injury and exposure to welding rod fumes.
