AUSTIN, Texas - Defendants in Texas have filed a motion to create a state court silica products liability MDL, seeking transfer and consolidation of certain pending and future silica claims filed in the state. In Re Silica Products Liability Litigation, No. 04-0606 (Texas Sup. Ct.).
The motion, filed July 7 in Texas Supreme Court, seeks transfer of 59 silica claims filed in Texas after Sept. 1, 2003, to a single state court judge.
