MADISON, Wis. - A state Supreme Court has affirmed the dismissal of a former foundry worker's strict liability claim against a supplier of silica, determining that the plaintiff failed to prove that the product was defective at the time it left the supplier's control. Haase v. Badger Mining Corp., No. 02-1681 (Wis. Sup. Ct.).
In a ruling issued July 2, the Wisconsin Supreme Court determined that plaintiff Laverne Haase failed to show that silica supplied to his employer by Badger Mining Corp. was defective and unreasonably dangerous in its intended use and that such defects may have caused his injuries.
