ATLANTA -- Defendants in several Georgia welding rod lawsuits continue to contend that plaintiffs have not pled conspiracy and fraud claims with the sufficient particularity, thus warranting a dismissal of the claims. Long, et al., v. Lincoln Electric Company, et al., No. 03VS52829 (Ga. State Ct., Fulton Cty.).
In a reply filed June 18 in the Georgia State Court for Fulton County, defendants refuted claims asserted in the plaintiffs' June 3 response which claimed that under Georgia law, the defendants can not move to dismiss on grounds of particularity without first asking the plaintiffs specify their claims.
