DuPont Renews Motion to Dismiss in Indiana Welding Rod Lawsuit

CLEVELAND -- Defendant E.I. Du Pont De Nemours and Company has filed a motion to dismiss in a welding rod lawsuit, arguing that the plaintiffs assert no claim upon which relief can be granted. In re: Welding Rod Products Liability Litigation, MDL Docket No. 1535; Markiewicz v. Arco, Inc., et al., Case No. 03-17336 (N.D. Ohio).

Filed June 1 in the U.S. District Court for the Northern District of Ohio, DuPont's motion reasserts a motion to dismiss originally filed in the Northern District of Indiana prior to transfer to the MDL, to which, the defendants state, the plaintiffs never opposed.
