LOS ANGELES -- A federal judge has remanded a California welding rod lawsuit, finding that the court lacked subject matter jurisdiction as diversity among plaintiffs and defendants did not exist. Cogburn, et al., v. BOC Group, et al., No. 04-03241 (C.D. Calif.).
According to sources, Judge Ronald S.W. Lew of the U.S. District Court for the Central District of California remanded the complaint June 28, the second complaint to be sent back to state court in just over two months. In doing so, the court sent the Cogburn lawsuit to the Los Angeles Superior Court, where it was originally filed.
