N.Y. Judge Dismisses Silica Claims Against Grinding Wheel Manufacturer

BUFFALO, N.Y. - A federal judge has thrown out a wrongful death complaint filed against the manufacturer of a silica-containing grinding wheel because the plaintiff failed to specify which laws the defendant allegedly violated in selling its product. Campbell v. Norton Company, No. 04-6130 (W.D. N.Y.).
In a Decision and Order issued June 9, Judge Michael A. Telesca of the U.S. District Court for the Western District of New York granted defendant Norton Company's motion to dismiss the complaint, finding that allegations contained in plaintiff Patricia Campbell's lawsuit failed to give Norton reasonable notice of the claims against it.
