MDL Judge Refuses to Strike Plaintiffs' Diagnoses, Orders Production of Sales Records

CORPUS CHRISTI, Texas - The judge overseeing the silica MDL has denied an attempt by defendants to have all cases pending on the federal court's docket thrown out for plaintiffs' alleged failure to substantiate their claims with a qualified diagnosis of silica-related disease. In Re: Silica Products Liability Litigation, MDL No. 1553 (S.D. Texas).
The ruling was issued following a hearing June 28 before Judge Janis Graham Jack of the U.S. District Court for the Southern District of Texas, sources close to the case told HarrisMartin Publishing.
