ATLANTA -- Holox, Ltd. has moved to dismiss warranty and strict liability claims in a Georgia welding rod lawsuit, arguing that the plaintiff erred in designating the defendant as a manufacturer of welding rod products. Rogers v. Lincoln Electric, et al., No. 02-VS-34890-C (Ga. State Ct., Fulton Cty.).
Filed May 1 in the Fulton County State Court, Holox contends that the claims fail because the plaintiff failed to properly give pre-suit notice as required under Georgia law, and failed to establish any sort of connection between the plaintiff and the defendant.
