CLEVELAND -- In an order entered May 10, Judge Kathleen M. O'Malley granted a stipulated motion made by Minnesota plaintiffs and NEMA to dismiss the trade association from the lawsuits without prejudice. In re Welding Rod Products Liability Litigation, MDL 1535 (N.D. Ohio).
The MDL Judge entered the order after the National Electric Manufacturers Association filed a May 3 motion in the U.S. District Court for the Northern District of Ohio to dismiss claims pending against it, because the trade association did not manufacture or distribute welding products nationally, and specifically not in Minnesota.
