CORPUS CHRISTI -- Several plaintiffs in various states recently filed oppositions to conditional transfers to the welding rod products liability MDL, arguing that the lawsuits cannot be transferred until the federal court rules on pending remand motions. Guillen, et al. v. Lincoln Electric, et al. No. 04-41 (S.D. Texas).
Filed April 27 before the Judicial Panel on Multidistrict Litigation, the Guillen plaintiffs moved to vacate their conditional transfer order, stating that until proper jurisdiction is determined, the case should not be transferred to the Northern District of Ohio.
