SAN FRANCISCO -- A federal judge has granted a motion to remand a California welding rod case to state Superior Court after determining that the non-diverse premises defendants named in the suit were not fraudulently joined, HarrisMartin Publishing is reporting. Janke, et al. v. BOC Financial Group, et al., No. C-04-0941 (N.D. Calif.).
In an order issued April 21, Judge Maxine M. Chesney of the U.S. District Court for the Northern District of California remanded the case to Alameda County Superior Court, ruling that the plaintiffs have adequately alleged causes of action against the premises defendants.
