Court Denies Rehearing of Decision Reversing Summary Judgment for Silica Defendants

TEXARKANA, Texas - A Texas appeals court has refused a request by several defendants to rehear its decision that reversed an award of summary judgment based on what the defendants said was a sham affidavit indicating that the plaintiff was never made aware that he had silicosis until less then two years before he filed suit. Youngblood v. Falcon Building Products, et al., No. 06-03-00020-CV (Texas App. Ct., Sixth Dist.).
