Machine Manufacturer Says It's Not Liable for Silicosis Caused by 'Component Part'

CAMDEN, N.J. - A grinding machine manufacturer argued in a brief filed recently that it had no duty to warn a New Jersey man of dangers associated with a silica-containing grinding wheel that was used with the product. Glowfeski v. Black and Decker Inc., et al., No. 04-538 (D. N.J.).
Defendant Black and Decker, Inc., argues in a reply brief filed March 19 in U.S. District Court for the District of New Jersey that the grinding wheel should not be considered a component part of the company's machine for the purposes of assigning liability for the plaintiff's alleged silicosis.
