Judge Grants Order Dismissing Welding Rod MDL Defendant

CLEVELAND -- The judge overseeing the welding rod MDL has granted the jointly proposed order dismissing defendant J.W. Harris from all proceedings, two months after the defendant filed a motion to dismiss under Ohio's successor non-liability law. In re Welding Rod Products Liability Litigation, MDL 1535 (N.D. Ohio).

Judge Kathleen O'Malley of the U.S. District Court for the Northern District of Ohio granted the motion on March 15, effectively dismissing J.W. Harris Company, Inc., without prejudice. The order releases the company from involvement in any case pending in the MDL or pending transfer to the MDL.
