CLEVELAND - The Welding Fume MDL plaintiffs have opposed a defense motion to require plaintiffs to produce certification by a non-MDL physician that they have a neurological disorder, arguing that only a good faith basis claim is needed to allege injury. In re: Welding Fume Products Liability Litigation. Case No. 1:03-cv-17000. MDL No. 1535 (N.D. Ohio).
On Dec. 30, Caterpillar Inc., General Electric Co., Deloro Stellite, Nichols Wire Inc., Select Arc. Inc., Stoody Co. and Thermadyne Holdings Corp. moved to amend a Dec. 9, 2003, case management order, which addressed pretrial consolidation and coordination, discovery and state court proceedings.
