CLEVELAND -- Two consumer defendants in the welding rod products liability MDL have filed a motion to dismiss claims of negligence, conspiracy and product liability filed against them based on their status as consumer defendants and not buyers or sellers of the allegedly defective products that plaintiffs say caused their injuries. In re Welding Rod Products Liability Litigation. MDL 1535 (N.D. Ohio).

Filed on Jan. 12 by defendants Caterpillar Inc. and General Electric Company, the motion states that the plaintiffs' own qualification of them as 'consumer' defendants precludes claims of negligence, product liability and conspiracy filed against the companies.
