MADISON, Wis. - A Wisconsin appeals court has withdrawn its decision to affirm the dismissal of a silica case just days after the state's Supreme Court agreed to hear argument in a similar case alleging injury as a result of exposure at the same location. Hanson, et al. v. Badger Mining Corp., No. 03-0756 (Wis. Ct. App., Dist. II).
In an order entered Feb. 3, the Second District Wisconsin Court of Appeals withdrew its Jan. 28 decision and held the appeal in abeyance until the Supreme Court renders its decision in Haase v. Badger Mining Corp.
