JENNINGS, La. - A Louisiana court has granted a motion for summary judgment filed by a silica supplier that claimed it had no duty to warn a former sandblaster of hazards associated with exposure to silica dust. Leopold v. Owens Corning, et al., No. C-571-98 (La. Dist. Ct., Jefferson Davis Parish).
In an order issued Dec. 22, the Jefferson Davis Parish District Court dismissed Southern Silica of Louisiana from a suit filed in 1998 by plaintiff Walter Leopold after the defendant argued that Leopold failed to show that his injuries were caused by exposure to the company's product.
