CHARLESTON, W.Va. -- A West Virginia plaintiff and General Electric have entered an agreed order dismissing the welding rod defendant, after General Electric filed a motion to dismiss on grounds of failure to state a claim and failure to plead fraud with particularity. Rose v. Lincoln Electric, et al., No. 04-C-814 (W.Va. Cir. Ct., Kanawha Cty.).
On Oct. 13, parties involved in the welding rod lawsuit filed an order in the West Virginia Circuit Court for Kanawha County, dismissing defendant General Electric without prejudice.
