JACKSON, Miss. -- A plaintiff in a Mississippi welding rod case has opposed a motion for interlocutory appeal of an order denying a venue transfer, arguing that defendants waived their right to object to venue upon removing the lawsuit. Lincoln Electric, et al. v. Blackmon, No. 2004-M-01896-SCT (Miss. Sup. Ct.).
In the Oct. 11 opposition filed in the Mississippi Supreme Court, plaintiff Joe Blackmon also contended that a trial court judge correctly determined that Holmes County, Mississippi, was the correct venue for Blackmon's claims because he was living with his son in the county at the time the lawsuit was …
