FAYETTE, Miss. - Summary judgment has been recommended for three defendants in a Mississippi silica case after the plaintiff failed to present evidence sufficient to show that he used or was exposed to the defendants' products and that they caused his silica-related injury. Day v. Pulmosan Safety Equipment Company, et al., No. 2002-055 (Miss. Cir. Ct., Jefferson Cty.).
In reports and recommendations issued Dec. 11, Special Master X.M. Frascogna found that product identification evidence offered on behalf of plaintiff Charles Day failed to present issues of fact that would be outcome determinative in his case.
