Defendants Challenge $330 Million Default in Silica Case

BROWNSVILLE, Texas - More than a dozen defendants have moved to vacate their respective portions of a nearly $330 million default judgment entered against them recently in a multi-plaintiff silica case in Texas. Fragoso, et al. v. American Optical Corp., et al., No. 2003-05-2778-G (Texas Dist. Ct., Cameron Cty.).

According to sources, Judge Abel Limas of the Cameron County District Court indicated during a hearing on Dec. 12 that he will take several of the motions to set aside the judgments under advisement before the parties reconvene for another hearing on the matter next month.
