California Court Denies Demurrer in Silica-Mixed Dust Case

LOS ANGELES - A California judge has denied defendants motion to demur a case filed by a former sandblaster and foundry worker who claimed he developed silica-related injury as a result of his workplace exposure. Ogan v. 3M Company, et al., No. BC293705 (Calif. Sup. Ct., Los Angeles Cty.).
According to sources, the Los Angeles Superior Court judge ruled Nov. 19 that the plaintiffs first amended complaint presented enough evidence under California law to survive the defendants' demurrers.
