Calif. Silica Defendants Cite Lack of Specificity, Statute of Limitations in Demurrers

LOS ANGELES - Defendants in a California mixed dust silica case have filed a new set of demurrers claiming that the plaintiff's underlying allegations lack specificity sufficient to state a cause of action for toxic exposure and are barred by the statute of limitations. Ogan v. 3M Company, et al., No. BC293705 (Calif. Sup. Ct., Los Angeles Cty.).
In briefs filed in late September, the defendants contend that Darrell Ogan, a former sandblaster and foundry worker, has included in his amended complaint little more specific information about his alleged silica- and asbestos-related injuries than his previous complaint contained.
