Sand Suppliers Cite Insurance Documents, Recent Decision in Motion to Reconsider Denial of Summary Judgment

WABASHA, Minn. - Several sand suppliers that failed to persuade a trial court to apply the sophisticated user doctrine in a Minnesota silica case have moved the court to reconsider its decision in light of newly discovered evidence provided by its insurer and a recent conflicting decision issued by the state's Court of Appeals. Wieland, et al. v. AIMCOR, et al., No. C6-00-565 (Minn. Dist. Ct., Wabasha Cty.).
