Texas Ceramics Worker, Defendants Battle over Statute of Limitations Ruling




TEXARKANA, Texas - Oral argument was expected to be held Nov. 12 in a former ceramics worker's appeal of an award of summary judgment to defendants who argue that doctors clearly communicated to the plaintiff more than two years before he filed his lawsuit that he suffered from work-related silicosis. Youngblood v. Falcon Building Products, et al., No. 06-03-00020-CV (Texas App. Ct., Sixth Dist.).

Plaintiff Johnny Youngblood and his wife filed the appeal earlier this year claiming that in July 1992, the Gregg County District Court erred when it held that the Youngbloods' lawsuit violated Texas' two-year statute of limitations.
