Mississippi Silica Case Settles on Eve of Trial; Next Setting Continued




PORT GIBSON, Miss. - The final defendant remaining in a closely-watched silica wrongful death claim filed on behalf of a former sandblaster in Mississippi has settled. Tinner, et al. v. Pulmosan Safety Equipment, et al., No. 2002-87 (Miss. Cir. Ct., Claiborne Cty.).

According to sources, plaintiff Shirley Tinner and Mississippi Valley Silica Co. reached an agreement to resolve allegations that the sand supplier was responsible for the death of Tinner's husband, LeRoy. The deal was struck late on Sept. 23, just hours before jury selection was to begin in Claiborne County Circuit Court.
