Demurrers Sustained with Leave to Amend in California Silica Case

LOS ANGELES - A state Superior Court judge has tentatively sustained demurrers filed by several defendants in a California silica case, giving plaintiffs an opportunity to amend about three-quarters of their complaint so that allegations may include more specificity. Ogan v. Union Pacific Railroad Company, et al., No. BC293705 (Calif. Super. Ct., Los Angeles Cty.).
Judge David L. Minning of the Los Angeles Superior Court sustained defendants' demurrers and ordered plaintiff Darrell Ogan to amend his complaint within the statutory limit in a decision issued July 28.
