PHILADELPHIA - Defendants have filed preliminary objections to a master long-form complaint filed in the Philadelphia silica litigation, asking the court to dismiss most of the plaintiffs' claims for failure to sufficiently and specifically state their allegations. In Re: Silica Products Liability Litigation, March Term 2003, No. 0001 (Pa. Comm. Pls., Philadelphia Cty.).
In a memorandum letter filed with the court on July 2, the defendants move to strike counts for products liability, misrepresentation, negligence and punitive damages because they contain merely 'buzz words' and 'boilerplate' claims that fail to allege an actionable or defensible claim.
