GALVESTON, Texas - A federal judge in Texas has ordered the transfer of a silica case to Virginia after determining that only one of the 182 sites where the plaintiff alleged exposure was located in Texas. Roman, et al. v. Belmont Construction Services, et al., No. 03-253 (S.D. Texas).
Determining that the parties - especially plaintiff Daniel S. Roman - would be better served by pursuing the case in Virginia, Judge Samuel B. Kent of the U.S. District Court for the Southern District of Texas ordered the case transferred to the Eastern District of Virginia.
