JACKSON, Miss. - Plaintiffs in a Mississippi silica case recently removed to federal court have filed a motion to remand the case on several grounds. Prince, et al., v. Pearl River Sand & Gravel Co., Inc., et al., No. 03-160LN (S.D. Miss.).
Among the arguments cited in favor of remand is the claim that defendants, who in April began removing dozens of cases involving more than 6,000 plaintiffs, failed to achieve consent to remove the case from all served defendants within the timeframe allowed under federal law.
