PORT GIBSON, Miss. - Argument was heard recently on a motion to strike a Mississippi silica defendant's motion for summary judgment that was based on inconsistent statements made by plaintiffs in their identification of the defendant's product. Green, et al. v. Clark Sand Co., et al., No. 2002-131 (Miss. Cir. Ct., Claiborne Cty.).

According to the motion to strike, which also included a motion for sanctions, defendant Vulcan Material Company sought summary judgment on Feb. 28, claiming that a photograph plaintiffs used to identify the Vulcan sandbag product allegedly linked to their silica-related disease was actually mislabeled.
