Wisconsin Supreme Court Won't Hear Respirator Company Appeal

MADISON, Wis. - The Wisconsin Supreme Court has turned down a request to hear the appeal of a decision that permitted a silicosis plaintiff to proceed with his claim against several respirator defendants, while dismissing as untimely similar claims against a sand supplier. Alix v. Badger Mining Corp., et al., No. 02-0005 (Wis. Sup. Ct.).
According to sources, the state's highest court denied respirator defendants' petition for review on March 13, granting remittitur and clearing the way for the claims of former foundry worker Darrell Alix to head to trial in Winnebago County Circuit Court.
