HOUSTON - Argument is set for later this month in the appeal of a Texas judge's decision to award summary judgment to two sand suppliers after they claimed the once-homeless plaintiff, who sued them after he was diagnosed with silicosis in 1998, had been informed years earlier that he suffered from the disease.
