MILWAUKEE - A plaintiff whose silicosis claim against certain respiratory defendants was revived recently by a state appeals court has responded to a petition filed in Wisconsin Supreme Court seeking review of the decision. Alix v. Badger Mining Corp., et al., No. 02-0005 (Wis. Sup. Ct.).
In a response brief filed Feb. 18, plaintiff Darrel Alix argues that the respirator companies that have sought review before the state's high court have no basis for doing so because the underlying appeals decision that reinstated his claim was based on longstanding legal principle.
