U.S. Silica Will Appeal Decision Upholding $7.5 Million Verdict

BEAUMONT, Texas - Defendants who recently lost a bid to overturn the largest verdict in the history of silica litigation are taking their argument to the Texas Supreme Court, according to court records and sources close to the case. U.S. Silica Co. v. Tompkins, No. 03-0195 (Texas Sup. Ct.).
On Feb. 26, counsel for defendant U.S. Silica filed a petition asking the state's highest court for an extension of time to file a petition to review the Ninth District Court of Appeals' recent decision to affirm a $7.5 million verdict awarded to plaintiff Donald Tompkins.
