JACKSON, Miss. - Defendants in Mississippi have filed a motion in state Supreme Court requesting that the approximately 10,000 silica claims due to be remanded from MDL 1553 be consolidated before a single judge. In Re: Remanded Federal MDL Silica Products Liability Litigation, No. n/a (Miss. Sup. Ct.).
The July 11 motion asks the high court to allow the cases, which were recently remanded by federal MDL Judge Janis Graham Jack, to remain bundled for pre-trial coordination and, ultimately, for a determination that they be dismissed for cause in accordance with the advisement of Jack's recent order regarding jurisdiction and …
