California Supreme Court Declines to Hear Appeal of Silica Coverage Matter

SACRAMENTO, Calif. - The California Supreme Court has declined to review a recent appellate court decision that allowed an insurer to deny coverage for two Mississippi silica lawsuits based on a policy's pollution exclusion. John Garamendi v. Golden Eagle Insurance Co., No. S133077 (Calif. Sup. Ct.).
The high court denied review in an order entered June 15, letting stand a March 9 decision by the First District Court of Appeal that upheld Golden Eagle Insurance Co.'s decision to deny coverage for underlying silica claims asserted against Pauli Systems Inc.
