MINNEAPOLIS - A defendant sand supplier that was recently denied summary judgment in a Minnesota silicosis case is appealing the decision to the state's court of appeals. Gray v. Badger Mining Corp., No. C4-02-2052 (Minn. Ct. App.).
Badger Mining Corp. filed its notice of appeal Nov. 25 in the Minnesota Court of Appeals, indicating that it will challenge the Aug. 28 decision by Hennepin County District Court Judge Cara Lee Neville, who denied the company's renewed motion for summary judgment and motion to dismiss the underlying complaint.
