TYLER, Texas - A state court judge in Texas has rescinded an order consolidating more than a dozen Texas silica personal injury cases that were set for trial in March. Tave v. U.S. Gypsum Company, et al., No. 44-886 (Texas Cty. Ct. Law, Smith Cty.).
Following a hearing on a motion to reconsider his previous decision to consolidate 17 silica cases pending in the Smith County Court of Law, Judge Thomas A. Dunn on Jan. 21 set aside the order, which had initially been entered on Dec. 2 without a prior hearing.
