JACKSON, Miss. - In a matter that could have broad implications for silica and other personal injury litigants in Mississippi, the state Supreme Court has passed a measure that allows its state courts to order independent medical examinations (IME) when asked to do so.
The Rule, adopted Jan. 10 as part of amendments to Rule 35 of the Mississippi Rules of Civil Procedure, makes Mississippi the last state in the nation to adopt a provision for ordering IMEs, sources told HarrisMartin Publishing. The Rule took effect on January 16.
