LEXINGTON, Ky. –– Several defendants have removed a TCE exposure suit to federal court in Kentucky, contending that the only non-diverse defendants in the in utero exposure case have been dismissed.

The defendants removed the case on May 21 to the U.S. District Court for the Eastern District of Kentucky, noting that an employer defendant and two employees of that defendant have since been dismissed from the case.

Darlene Smith asserted the claims in Kentucky’s Circuit Court for Madison County in April, contending that her husband, Robert Smith, worked at a Dresser Industries plant for nearly 40 years. During this …
