Calif. Appellate Court Vacates Order Dismissing Appeal, Accepts Opening Brief in Gasoline Contamination Case




LOS ANGELES –– A California appellate court has opted to allow a real estate developer to appeal a defense verdict in a gasoline contamination suit, reversing its previous position that the appeal should be dismissed since the appellant did not submit its opening brief in time.

On May 6, the California 2nd District Court of Appeal issued an order reinstating the appeal and stipulated that it had accepted the appellant’s opening brief.

According to the court’s online docket, the appeal was dismissed on April 7 for failure to file an opening brief.
