Conn. Federal Court Tosses PCB-Contamination Suit, Says Claim Time-Barred

HARTFORD, Conn. –– A Connecticut federal court has tossed a PCB-contamination suit, finding that the plaintiff’s claims are time-barred and precluded under an exclusive remedy provision.
In the March 29 opinion, the U.S. District Court for the District of Connecticut wrote that while the plaintiff’s Products Liability Act claims could proceed under an exception to the state’s statute of repose, the claims are ultimately barred by the state’s statute of limitations.
The court entered a judgment in favor of the defendants one day later.
