JACKSON, Miss. –– A Mississippi federal court has granted a motion to exclude testimony from a plaintiff’s expert in a silica exposure case, saying that while the individual described himself as an industrial hygienist, he is in fact not certified by any organization in the field of industrial hygiene.
In the Feb. 27 opinion, the U.S. District Court for the Southern District of Mississippi wrote that while Darell Bevis could testify as to the proper use of respirators, he could not testify as to the design and manufacture of the products.
