Parties in C-8 MDL Docket Spar on Production of Discovery Responses from Plaintiffs

CLEVELAND –– E.I du Pont de Nemours has moved to compel discovery responses from plaintiffs with claims pending in the national coordinated C-8 chemical release docket, saying the plaintiffs’ steering committee has “repeatedly thwarted every attempt by DuPont to receive responses to basic written discovery….”

In a Feb. 3 response brief filed in the U.S. District Court for the Southern District of Ohio, however, the plaintiffs refuted the allegations, saying that the discovery responses have been supplemented in good faith.
