Ky. Federal Court Declines to Expand Scope of Discovery in Radiation Exposure Suits

PADUCAH, Ky. –– A Kentucky federal court has denied plaintiff efforts to expand the scope of discovery in a radiation exposure suit, saying that review of the particular claim are properly confined to an administrative record.
The U.S. District Court for the Western District of Kentucky entered the order in 11 similar cases, the ruling noted.
The underlying plaintiffs argued that former employees or contractors at the Paducah Gaseous Diffusion Plant were exposed to harmful amounts of radiation or other toxic substances. The plaintiffs brought the claims under the Energy Employees Occupational Illness Compensation Program Act of 2000.
