Fla. Court Dismisses Toluene Exposure Suit, Cites ‘Obtuse, Confusing’ Complaint

ORLANDO, Fla. –– A Florida federal court has granted a defense motion to dismiss a toluene exposure complaint on pleading grounds, but afforded the plaintiffs one additional opportunity to file “an amended complaint in compliance with minimum pleading requirements.”

In a four-page order issued Jan. 23, the U.S. District Court for the Middle District of Florida found that the framework of the plaintiffs’ complaint is “obtuse, confusing, and fails to comply with the requirement that separate claim be set forth in separate counts.”
