MORGANTOWN, W.Va. –– A West Virginia man has filed a lawsuit contending that activities by a number of defendants participating in demolition, excavation and construction at sites adjacent to his home have released toxic dusts, soils, fungi and debris.
Leory Loscar filed the Dec. 17 complaint in the West Virginia Circuit Court for Monongalia County, contending that the defendants conducted operations on properties adjacent to his, exposing him to toxic fungi, including mucoromycotina and zygomycota.
Loscar said that in Jan. 2013, he was admitted to a medical center with “un-diagnosable confusion and left side facial droop.”
